(Family law / Division of contingent liability)
The husband and wife were married for 12 years, during which the wife remained at home to care for the children of the marriage.  The wife was awarded support in the divorce action, but the trial judge also allowed contingent tax liabilities to be shared equally on an "if and when" basis.  The Court upheld the trial judge's award, finding that although the BC Family Relations Act prohibits division of debts between spouses, it does allow orders for a spouse to pay compensation to the other to adjust the division of assets.
