H. sued the manufacturer of an ice re-surfacing machine after being badly burned in an explosion. The Court restored the trial judge’s ruling that H. did not establish negligence. The central issues were foreseeability and causality. The “but for” test remains the central test for causality. The “material contribution” test is to be applied only in exceptional cases.
